Welcome to Iridium, provided by Autumn Creek Press, LLC("Iridium," "we," "us," or "our"). By downloading or using the Iridium mobile app or website at https://iridium.fit, you agree to these Terms of Use.

1. Agreement to Terms

Your use of Iridium constitutes acceptance of these Terms and our Privacy Policy. If you disagree, do not use the Services.

2. The Services

Iridium provides workout routines, recovery insights, and recommendations based on your input and connected data sources. We do not provide medical or professional fitness advice. Use the Services at your own risk.

3. License

We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. All rights not granted are reserved by us.

4. User Conduct

You must be at least 18 years old. You agree not to misuse the Services, interfere with operations, or violate laws.

5. Payments & Subscriptions

Some Services require an auto-renewing subscription purchased through Apple's App Store. The price, subscription period, trial or introductory offer (if any), and renewal terms shown in Apple's purchase sheet when you subscribe control your purchase. Apple charges the payment method associated with your Apple Account and manages App Store billing.

You must manage or cancel an App Store subscription through Apple. In Iridium, open Settings → Manage Subscription, or on an iPhone or iPad open Settings → your name → Subscriptions → Iridium. You can also use Apple's subscription management page. Autumn Creek Press, LLC and Iridium support cannot cancel an App Store subscription for you. Emailing us, deleting the app, or deleting app data does not cancel a subscription.

Apple determines refund eligibility for App Store purchases. To request a refund, visit Apple's Report a Problem page. These terms do not limit any non-waivable refund or cancellation rights available under applicable law.

6. Disclaimers

The Services are provided "as is." Iridium makes no warranties of fitness, accuracy, or uninterrupted availability. Use of the app and any exercises suggested by it is entirely at your own risk.

7. Limitation of Liability

To the maximum extent allowed by law, Iridium and its affiliates shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability shall not exceed the amount paid by you to Iridium in the preceding 12 months.

8. Indemnification

You agree to indemnify and hold harmless Iridium, its officers, and employees from any claims arising from your misuse of the Services or violation of these Terms.

9. Dispute Resolution

Canadian consumers. If you are a consumer resident in Canada, this Section 9 does not apply to you. You may bring a dispute in any court or tribunal with jurisdiction under applicable law and may participate in any class proceeding available under that law.

Other users. For users other than Canadian consumers, disputes shall be resolved by binding arbitration in Salt Lake City, Utah under the rules of the American Arbitration Association. Those users waive trial by jury and class-action participation to the extent permitted by applicable law.

10. Governing Law

Except to the extent mandatory law in your province, territory, state, or country applies, these Terms are governed by the laws of the State of Utah, U.S.A.

11. Canadian Consumers

Sections 6 through 8 and Section 10 apply to Canadian consumers only to the extent permitted by applicable federal, provincial, and territorial law. Nothing in these Terms waives a non-waivable consumer right.
